DESCRIPTION

The deep understanding of contracts and their diligent management is key to project success. This is a 4-days workshop that combines the theory behind contract law with the best practices in procurement and contract management.
During this workshop, we will provide the participants with an overview of the contracting nexus and the theories behind various contract laws and contract forms and the most important procurement modalities and in preparing and securing a contract that meets the set economic and technical objectives as well as value for money from both public and private sector perspectives. In addition, participants will visualize the contracting relationships between the ‘purchaser’ and the ‘contractor’ and analyze the sensitivity of such a relationship.

Further to the above, we will dive into the key success factors in managing service, ICT, supply and works contracts with toolkits, checklists and case studies to give the participants hands-on application of such best practices to their various different types of contracts. Then, the proceedings will concentrate on how to make the contract management process a success from both a contract and a project perspective. Uniquely, this course offers participants a hands on practical learning experience in the drafting and management of contracts, including tools to analyze delays to schedules and to assess disruption costs.

Since the multitude of contract forms are being harmonized on a large and international scale, we will consider such harmonized forms of contract such as the FIDIC contracts, the WB information system contracts, the EU contracts, etc… for the purpose of this course.  

For in-company training we could offer several variations/levels of this course (basic/advanced): service contract management; information systems contract management; supplies/equipment contract management; works contract management; as well as the possibility to concentrate on the procurement side of such projects and the methodologies to attain value for money,
